    Maternity leave in Ontario

    Employees who are pregnant are entitled to up to 17 weeks of unpaid maternity leave. In some scenarios, this leave may be extended. Employers are not required to pay wages to employees on maternity leave.

    Every new parent is entitled to take unpaid parental leave when their child is born or first placed in their care (such as through adoption). Birth mothers who are on maternity leave are entitled to up to 61 weeks of parental leave. All new parents, including those who do not take maternity leave, are entitled to up to 63 weeks of parental leave.

    Parental leave is not included in maternity leave. Both forms of leave are therefore available to biological mothers. In addition, the right to parental leave is separate from the right to maternity leave. For example, a biological father may be entitled to parental leave while the biological mother is on maternity or parental leave.

    Employees on leave have the option to continue to participate in certain benefit programs and maintain their seniority. Generally, employees are required to return to their positions after their maternity or parental leave ends.

    Employers are prohibited from penalizing in any way employees who take, are considering taking, or are eligible for maternity or parental leave.
